Here is where things stand right now:

✅ HB 1628 — The regulation bill passed the House. This is the right approach — 21+ age limits, labeling, and licensing for natural kratom. It is now headed to the Senate.

🚨 SB 2408 — The Senate passed a blanket ban on ALL kratom including natural leaf and sent it to the House for a vote. The House takes it up tomorrow morning.

The legislature reconvenes tomorrow morning. Tonight is the window. We need to flood every legislator with calls and emails right now urging them to oppose SB 2408 and support the regulation approach the House already passed in HB 1628.

The House already did the right thing. Don't let the Senate's blanket ban undo it.

Update — September 2, 2026

During the September 1 and 2 hearings, legislation that would have scheduled synthetic derivatives while maintaining access to natural kratom leaf was amended into a full blanket kratom ban. The legislature then decided not to allow public testimony. Consumer voices and expert testimony supporting responsible regulation were bypassed entirely.

Important update on SB 2408: Initially, SB 2408 targeted dangerous synthetics while preserving access to natural kratom leaf. That bill has since been amended into a full blanket kratom ban. We are now urging everyone to vote NO on SB 2408 in its current form. The bill is not the same bill that was previously supported.

A blanket ban on natural kratom was never proposed before this special session — advocates never had a real chance to be heard. We need everyone — North Dakota residents and kratom consumers across the country — to contact every legislator they can reach right now.

Why a Blanket Ban Is the Wrong Approach

SB 2408 in its original form represented exactly the kind of science-based, targeted policy that responsible kratom advocates have been pushing for — scheduling dangerous synthetic mitragynine derivatives while protecting access to natural kratom leaf. The amended version abandons that distinction entirely.

Natural kratom leaf and concentrated synthetic 7-OH are fundamentally different products. The DEA has already moved to place concentrated synthetic 7-OH into Schedule I federally. The FDA has specifically recommended that synthetic 7-OH be classified as a controlled substance — not natural kratom leaf. A blanket ban that treats them identically ignores the science and punishes responsible consumers for a problem they did not create.

Kratom advocates have taken this message directly to Washington. In a recent Congressional briefing, advocates urged lawmakers to support natural kratom leaf products while warning of the distinct risks posed by synthetic concentrates — reinforcing the same distinction that federal regulators have already drawn.
