ALABAMA
🚫 Kratom is illegal in Alabama as of May 2016. Kratom is categorized as a Schedule I controlled substance. The American Kratom Association is working with lobbyists to replace the ban with the Kratom Consumer Protection Act.
ALASKA
✅ Kratom is currently legal in the state of Alaska.
ARIZONA
🌱 Kratom is currently legal in Arizona at this time and has passed the Kratom Consumer Protection Act in 2019.

CALIFORNIA
✅ 🟡 Kratom is currently legal in the state of California, except for the city of San Diego and the city of Oceanside. Kratom was banned in San Diego, CA in 2016. They are currently taking a similar law to the KCPA into consideration.
COLORADO
🌱 Kratom is currently legal in Colorado at this time and has passed the Kratom Consumer Protection Act in 2022. However, a few cities have some restrictions on kratom:
Denver, CO: Requires kratom products to be labeled with a consumer advisory warning.
Parker, CO: Kratom is banned for sale, however, possession is allowed.
Monument, CO: Kratom is banned for sale, however, possession is still allowed.
Castle Rock, CO: Kratom cannot be sold to anyone under 18.
CONNECTICUT
✅ Kratom is currently legal in the state of Connecticut at this time. There is a current proposed ban on kratom sales for anyone under the age of 21 as of February, 2023, but no further action has been taken.
DELAWARE
✅ Kratom is currently legal in the state of Delaware.
FLORIDA
🌱 Kratom is currently legal in Florida at this time and has passed the Kratom Consumer Protection Act in 2023. However, kratom is still banned in Sarasota County since 2014.
GEORGIA
🌱 Kratom is currently legal in Georgia at this time and has passed the Kratom Consumer Protection Act in 2019. Modifications to Georgia’s KCPA are expected in 2024.
HAWAII
✅ Kratom is currently legal in the state of Hawaii.
IDAHO
✅ Kratom is currently legal in the state of Idaho.
ILLINOIS
✅ 🟡 Kratom is currently legal in the state of Illinois for individuals over the age of 18, except for the following cities:
Alton, IL: Kratom is banned for use, sale, and possession.
Jerseyville, IL: Kratom is banned for use, sale, and possession.
Glen Carbon, IL: Kratom is banned for use, sale, and possession.
Edwardsville, IL: Kratom is banned for use, sale, and possession.

INDIANA
🚫 Kratom is illegal in the state of Indiana since 2014. The Indiana bill incorrectly categorizes kratom as a synthetic drug, therefore kratom is scheduled as a synthetic controlled substance.

KANSAS
✅ Kratom is legal in the state of Kansas. There is a pending KCPA that was differed until the 2024 legislative session.
KENTUCKY
✅ Kratom is legal in the state of Kentucky. Kentucky faced a proposed ban in 2022 but was stopped.
LOUISIANA
✅ 🟡 Kratom is currently legal in the state of Louisiana for individuals over the age of 21, except for the following parishes:
Ascension, LA: Kratom is banned for use, sale, and possession.
Franklin, LA: Kratom is banned for use, sale, and possession.

MAINE
✅ Kratom is legal in the state of Maine.
MARYLAND
✅ Kratom is legal in the state of Maryland. There were kratom ban attempts in Maryland in the past, but they all failed to pass.
MASSACHUSETTS
✅ Kratom is legal in the state of Massachusetts. There is currently a pending KCPA in 2023.
MICHIGAN
✅ Kratom is legal in the state of Michigan. There is a pending Michigan Kratom Consumer Protection Act in 2023.
MINNESOTA
✅ Kratom is legal in the state of Minnesota. There is a pending Minnesota Kratom Consumer Protection Act in 2023.
MISSISSIPPI
✅ 🟡 Kratom is currently legal in the state of Mississippi, however, multiple counties and a total of 33 cities have banned the sale, use and possession of kratom. Mississippi continues to face state-wide and local kratom bans. The American Kratom Association is heavily advocating in the state and have been successful preventing bans in the past.

MONTANA
✅ Kratom is legal in the state of Montana. Although Montana faced a kratom ban in 2023’s legislative session, it was ultimately unsuccessful.
NEBRASKA
✅ Kratom is legal in the state of Nebraska.
NEVADA
🌱 Kratom is currently legal in the state of Nevada at this time and has passed the Kratom Consumer Protection Act in 2019. However, modifications to the KCPA has been under assault by the current Governor and Board of Pharmacy. The American Kratom Association is working with legislatures to prevent any further bans from happening.
NEW HAMPSHIRE
Kratom is currently legal in the state of New Hampshire for individuals over the age of 18, except for the the city of Franklin, NH, where kratom is banned. The New Hampshire Kratom Consumer Protection Act has passed in the Senate and is awaiting further action. Advocacy by kratom consumers and the American Kratom Association’s efforts have made sure kratom stays legal in the state.
NEW JERSEY
✅ Kratom is legal in the state of New Jersey. There is a pending Kratom Consumer Protection Act in 2023.
NEW MEXICO
✅ Kratom is legal in the state of New Mexico.
NEW YORK
✅ Kratom is legal in the state of New York. The New York Kratom Consumer Protection Act is pending legislation in 2023.
NORTH CAROLINA
✅ 🟡 Kratom is legal in the state of North Carolina, with the age restriction of 18+. There is a Kratom Consumer Protection Act bill filed and is pending legislation. North Carolina faced a kratom ban in 2016, which fortunately did not follow through.
NORTH DAKOTA
✅ Kratom is legal in the state of North Dakota.
OHIO
✅ Kratom is legal in the state of Ohio. As of 2023, there is an active KCPA bill pending in legislation. In the past, the Ohio Board of Pharmacy attempted to schedule kratom as a controlled substance, however, after the American Kratom Association actively fought against the ban, the Board of Pharmacy withdrew their proposal.

🌱 Kratom is currently legal in the state of Oklahoma at this time and has passed the Kratom Consumer Protection Act in 2021.
OREGON
🌱 Kratom is currently legal in the state of Oregon at this time and has passed the Kratom Consumer Protection Act in 2022.
PENNSYLVANIA
✅ Kratom is legal in the state of Pennsylvania. A Kratom Consumer Protection Act was filed in 2023.
RHODE ISLAND
🚫 Kratom is illegal in the state of Rhode Island and is considered a scheduled controlled substance in the state. Fortunately, a Kratom Consumer Protection Act bill is filed. The Rhode Island Department of Health agree with the American Kratom Association’s recommendations that kratom does not meet Rhode Island’s criteria for scheduling.
SOUTH CAROLINA
✅ Kratom is legal in the state of South Carolina. In 2023, South Carolina did face a kratom ban bill, which ultimately expired in session. The only way the a ban could be placed is if there is an amendment to another bill.
SOUTH DAKOTA
✅ Kratom is legal in the state of South Dakota. Despite the state facing kratom bans in the past, legislature rejected these bans and is now considering the KCPA.
TENNESSEE
✅ 🟡 Kratom is legal in the state of Tennessee with an age restriction of 21+, and proper labeling policies. There was a kratom ban in prior years, but the Tennessee State Attorney General ruled that it will only apply to synthetic kratom products. There was a proposed KCPA bill in 2023, but was killed in legislation by the Chairman of the Senate Judiciary Committee.
TEXAS
🌱 Kratom is currently legal in the state of Texas at this time and has passed the Kratom Consumer Protection Act in 2022.
UTAH
🌱 Kratom is currently legal in the state of Utah at this time and has passed the Kratom Consumer Protection Act in 2019. Utah was the first state to pass the KCPA.
VERMONT
🚫 Kratom is illegal in the state of Vermont and is considered a scheduled controlled substance in the state. However, in 2023, the Vermont Department of Health agreed to remove kratom from the Schedule I listing. There is a pending KCPA in place and is being considered by the Vermont legislature. The lift of the Vermont kratom ban will occur after formal legal proceedings are finalized.

🌱 Kratom is currently legal in the state of Virginia at this time and has passed the Kratom Consumer Protection Act in 2023.
WASHINGTON
✅ Kratom is legal in the state of Washington. A kratom ban bill was proposed back in 2022, but was removed after the KCPA was introduced.
