MASSACHUSETTS KRATOM REGULATION: HOUSE PASSES SMART REGULATIONS — HELP KEEP THEM IN THE FINAL BILL

This is good news — and we need to act on it fast.

The Massachusetts House passed smart kratom regulations as part of its Economic Development bill. A six-member conference committee will now decide if that language stays in the final bill. At the same time, we are continuing to urge Governor Healey to reverse the emergency ban on natural kratom leaf.

Two actions needed right now — contact the conference committee and contact the Governor.

Important Notice for Massachusetts Customers

The Massachusetts emergency ban is still in effect. We cannot ship kratom to Massachusetts addresses at this time. We are closely monitoring the situation and will update Massachusetts customers as soon as the status changes.

Why This Matters

The Massachusetts House did the right thing by passing smart kratom regulations as part of the Economic Development bill. That language draws exactly the distinction that federal regulators have already drawn — targeting dangerous synthetic products while preserving responsible adult access to natural kratom leaf.

The FDA and DEA have taken targeted action against dangerous, chemically manipulated synthetic 7-OH products while leaving traditional botanical kratom leaf alone. The House-passed regulations follow that federal lead. The conference committee needs to keep them in the final bill.

At the same time, the emergency ban on all kratom issued by Governor Healey remains in effect. That ban ignores the same federal distinction the House-passed regulations got right — sweeping natural kratom leaf into the same prohibition as dangerous synthetic concentrates. Governor Healey’s own press release explicitly acknowledged that newer kratom products contain highly concentrated or laboratory-modified compounds that carry significantly stronger risks. That is exactly the distinction the emergency ban ignores. The Governor needs to hear from consumers right now that reversing that ban is the right call.

Massachusetts already has lawmakers working on kratom regulation legislation. This is not a choice between doing nothing and banning kratom. We can support 21+ sales, independent testing, accurate labeling, manufacturing standards, and consumer protection WITHOUT criminalizing traditional botanical kratom leaf.

Kratom advocates have taken this message directly to Washington. In a recent Congressional briefing, advocates urged lawmakers to support natural kratom leaf products while warning of the distinct risks posed by synthetic concentrates — reinforcing the same distinction that federal regulators have already drawn. That distinction was further reinforced by an FDA clinical trial — the first of its kind — which examined kratom’s pharmacological profile and underscored why natural leaf should not be treated the same as dangerous synthetic 7-OH. The Bigger Picture

The House did the right thing. Now two more steps are needed — the conference committee must keep the regulation language in the final Economic Development bill, and Governor Healey must reverse the emergency ban on natural kratom leaf.

This is also a national moment. Massachusetts is not the only state watching. What happens here sends a signal to governors and health departments across the country about whether emergency orders targeting natural kratom leaf will be met with organized, effective consumer opposition.
