Kratom is legal for sale and consumption in Nevada, with a minimum age requirement of 18. In 2019, Nevada became the fourth state to pass the Kratom Consumer Protection Act (KCPA).

The Kratom Consumer Protection Act protects Nevada consumers with stringent standards for the manufacturing, labeling, and testing of kratom products to guarantee their safety and purity.

The History of Kratom Legislation in Nevada

Kratom is currently legal in Nevada. However, challenges to its legality can still arise.

The Nevada State Board of Pharmacy held a public hearing to reconsider kratom’s legal status, proposing to classify it as a Schedule 1 Controlled Substance. 

Fortunately, due to Advocacy efforts by the American Kratom Association (AKA) and passionate consumers, the Board ultimately removed the request from the agenda, preserving kratom’s legal status in the state.

Despite this victory, the KCPA continues to face challenges. 

In 2022, Rep. Duy Nguyen introduced bill AB322, to strengthen and modernize kratom regulations. The bill sought to classify kratom as a food product, establish a regulatory framework for manufacturers and sellers, and prohibit the sale of contaminated products. It also included provisions to prevent kratom from being scheduled as a controlled substance at the state level, aligning kratom policy with federal substance guidelines.

However, Governor Joe Lombardo vetoed AB322, citing outdated Food and Drug Administration (FDA) guidelines and the lack of approved medical uses for kratom as reasons for his decision.

By vetoing the bill, which aimed to establish a regulated market for kratom as a food product, Lombardo stalled efforts to enhance consumer protections, despite limited scientific evidence supporting his claims.

The same evidence underlying Lombardo’s claims is what the FDA used in 2016 to attempt to influence bans on kratom at both the state and federal levels. Eventually, the Drug Enforcement Administration (DEA) announced its intention to schedule kratom but quickly retreated in the face of public backlash and insufficient scientific support.

As a result, the veto left these regulatory improvements on hold, preserving the 2019 framework for now.

Kratom advocates in Nevada and across the country face an uphill battle as they push for stringent consumer protections amidst ongoing legal and political resistance.
