Ohio’s recent actions against “mitragynine-related products” claimed they were not targeted toward products made from natural kratom leaf; however, key distinctions in the language from the state’s authorities have made it illegal for Super Speciosa to sell certain kratom products in the state. 

Due to limitations requiring kratom products to be sold in “vegetation form”, the state of Ohio has banned kratom extracts and any other product that does not meet specific limitations based on outdated FDA guidance. The actions taken by Gov. Mike DeWine and the Ohio Board of Pharmacy (BOP) have not only banned the sale of those kratom products but also labeled any product that does not meet their arbitrary standards as Schedule I substances in the state, meaning it is illegal to possess kratom in the forms covered by the emergency rule and executive order

That rule applies for 180 days from Dec. 12, when it was signed by DeWine, and during that period, certain products will not be available to ship to the state of Ohio. Although the actions taken do not align with recent guidance from the Food and Drug Administration (FDA), Super Speciosa recognizes the authority of the state’s agencies and the governor and will continue our policy of adhering to all state laws and restrictions placed on kratom products. 

DeWine’s executive order does not currently target mitragynine, but the governor included a quote in his news release on the matter, indicating a request to the BOP to target all kratom products in the future. That goes against the FDA’s revised stance, which makes a clear distinction between “enhanced” products with elevated levels of 7-hydroxymitragynine (7-OH) and natural leaf kratom products

The good news for kratom customers in Ohio is that the formal process to make the rule prominent will run through the state legislature, and give residents the chance to testify before lawmakers to make the case for natural leaf kratom. Those meetings will take place in the 180-day window created by the recent BOP rule, and more information on how customers can push back against the restrictions will be made available in the coming weeks and months.
